ЭДИЙН ЗАСГИЙН ЭРХ ЧӨЛӨӨНИЙ ТУХАЙ ХУУЛИЙН ТӨСЛИЙН ЭЦСИЙН САНАЛЫГ ХЭЛЭЛЦЛЭЭ.

Ерөнхий сайдын дэргэдэх Эдийн засгийн хөгжлийн зөвлөлийн ээлжит хурлаар Эдийн засгийн эрх чөлөөний тухай хуулийг хэлэлцэж, эцсийн саналыг сонслоо. Өнгөрсөн хугацаанд зөвлөлийн гишүүд, МҮХАҮТ, Улаанбаатар хотын танхим, Монголын бизнесийн зөвлөл, мэргэжлийн холбоод, бизнес эрхлэгчдээс хуулийн заалт, үндсэн концепц зэрэгт нийт 20 гаруй санал оруулжээ.

Зах зээлийн нийгмийг сонгож, чөлөөт эдийн засгийн тогтолцооруу шилжээд 30 гаруй жил болж байгаа манай улсын хувьд эдийн засгийн эрх чөлөөг хангасан, түүний үзэл баримтлалыг тунхагласан хууль байхгүй байна. Харин эсрэгээрээ эдийн засгийн эрх чөлөөг боомилсон, хавчсан салбар бүрийн хууль журамтай явж ирсэн. Тиймээс хувийн хэвшил эрдэмтэн, судлаачдын санал зөвлөмжийг сонсож, шат бүрээр хэлэлцүүлэг өрнүүлж байна.

Эдийн засаг, судлаачдын өгч буй гол санал:

• Төр өөрөө эдийн засгийн салбарт орж хувийн хэвшилтэй өрсөлдөж ирсэн. Төр ямар салбарт орж бизнес эрхлэхгүй вэ гэдэг хязгаарыг хуульд тусгах.

• Мөн аливаа тусгай зөвшөөрөл, үйл ажилагааг цахимжуулаад хангалтгүй бөгөөд төрийн хяналт шалгалт, зөвшөөрөл бодитоор буурахгүй байгааг хуульд зохицуулж өгөх

• Хуулийн этгээдийн улсын бүртгэлийг танхимуудад олгох.

• Төр өөрөө үзэсгэлэн, арга хэмжээ зохион байгуулах заалтыг хасах.

• Төрийн алба хаагчын буруутай үйл ажиллагаанаас болоод хувийн хэвшил хохирсон бол хариуцлага хүлээн, хохирол төлүүлэх үйл явц дутагдалтай байна. Хохирлын хэмжээг хөндлөнгийн аудит тодорхойлдог болох.

• Анх удаа тусгай зөвшөөрөл авах гэж буй компаниас гэрээний хэрэгжилт нэхдэг заалтыг цуцлах.

FINAL PROPOSALS FOR THE DRAFT LAW ON ECONOMIC FREEDOM DISCUSSED

At the regular meeting of the Economic Development Council under the Prime Minister, the Draft Law on Economic Freedom was reviewed and its final proposals were presented. Over the course of the discussions, Council members, the Mongolian National Chamber of Commerce and Industry (MNCCI), the Ulaanbaatar Chamber of Commerce, the Business Council of Mongolia, professional associations, and business representatives submitted more than 20 recommendations concerning the provisions and overall concept of the draft law.

Although Mongolia adopted a market-based economy and transitioned to a free economic system more than 30 years ago, the country still lacks a law that guarantees economic freedom and formally establishes its guiding principles. On the contrary, various sector-specific laws and regulations have often restricted and constrained economic freedom. Therefore, extensive consultations have been conducted at every stage, incorporating the views and recommendations of private sector representatives, academics, and researchers.

Key Recommendations from Economists and Researchers:

• The government has traditionally participated directly in economic activities and competed with the private sector. The law should clearly define the sectors in which the government may not engage in business activities.

• Simply digitalizing licenses and administrative procedures is insufficient. The law should ensure a real reduction in government inspections, oversight, and licensing requirements.

• The authority to register legal entities should be delegated to chambers of commerce.

• Provisions allowing the government to organize exhibitions and commercial events should be removed.

• When private businesses suffer losses due to the wrongful actions of public officials, existing mechanisms for accountability and compensation remain inadequate. The law should require independent auditors to determine the amount of damages.

• The requirement that first-time applicants for special licenses demonstrate prior contract performance should be abolished.
